The above Act makes it a criminal offence for NBLT or any other employer to employ somebody who is ineligible to work in this Country.
Prospective employees are required to produce either one document from list 1 or two documents from a combination in List 1 or one document (or document combinations if stated) from list 2.
Any one of the following documents included below can be accepted:
1. A passport showing that the holder is a British citizen, or has a right of abode in the United Kingdom.
2. A document showing that the holder is a national of a European Economic Area country or Switzerland. This must be a national passport or national identity card.
3. A residence permit issued by the Home Office to a national from a European Economic Area country or Switzerland.
4. A passport or other documentation issued by the Home Office which has an endorsement stating that the holder has a current right of residence in the United Kingdom as the family member of a national from a European Economic Area country or Switzerland who is a resident in the United Kingdom.
5. A Biometric Immigration Document issued by the Border and Immigration Agency to the holder which indicates that the person named in it is allowed to stay indefinitely in the United Kingdom or has no time limit on their stay in the United Kingdom
6. A passport or other travel document endorsed to show that the holder is exempt from immigration control, can stay indefinitely in the United Kingdom, or has no time limit on their stay.
7. A passport or other travel document endorsed to show that the holder can stay in the United Kingdom; and that this endorsement allows the holder to do the type of work you are offering if they do not have a work permit.
Document Combinations
A combination of two documents from the following can be accepted
First Combination
• An official document stating the person’s permanent National Insurance Number and their name issued by a Government agency or a previous employer. This could be P45, P60, National Insurance card or a letter from a Government agency.
In addition to this, one of the following documents will need to be presented
8. An immigration Status Document issued by the Home Office or the Border and Immigration Agency stating that the person named in it can stay indefinitely in the United Kingdom or has no time limit on their stay.
9. A full birth certificate issued in the United Kingdom giving the names of at least one of the holders parents.
10. A full adoption certificate issued in the United Kingdom giving the names of at least one of the holders adoptive parents.
11. A birth certificate issued in the Channel Islands, the Isle of Man or Ireland.
12. A full adoption certificate issued in the Channel Islands, the Isle of Man or Ireland.
13. A certificate of registration or naturalisation as a British Citizen.
14. A letter issued by the Home Office or the Border and Immigration Agency which indicates that the person named is allowed to stay indefinitely in the United Kingdom.
The listed documents will only be valid for 12 months, after which checks must be repeated every 12 months until the employment has ended or until the employee is able to produce documents from List 1, indicating a permanent right to work in the UK.
• A passport or travel document that stated that the holder is allowed to stay in the United Kingdom and is allowed to do the work in question provided that it does not require a work permit.
• A Biometric Immigration Document issued by the Border and Immigration Agency which indicates the person named on it can stay in the United Kingdom and can do the work in question.
• A work permit or other approval to take employment issued by the Home Office or the Border and Immigration Agency when produced in combination with either a passport or other travel document that states the holder is allowed to stay in the United Kingdom and is allowed to do the work in question, or a letter issued by the Home Office or the Border and Immigration Agency to the holder, employer or prospective employer confirming the same.
• A residence card or document issued by the Home Office or the Border and Immigration Agency to a family member of a national of an EEA country or Switzerland.
• An official document giving the person’s permanent National Insurance Number and their name issued by a Government agency or a previous employer when produced in combination with
• A letter issued by the Home Office or the Border and Immigration Agency to the holder or the employer or prospective employer, that indicates that the named person can stay in the United Kingdom and is allowed to do the work in question
OR
• An Immigration Status Document issued by the Home Office or the Border and Immigration Agency that states the person named on it can stay in the United Kingdom, and is allowed to do the type of work in question
• Evidence of verification by the Border and Immigration Agency Employer Checking Service, when produced in combination with
• An Application Registration Card issued by the Home Office or the Border and Immigration Agency stating that the holder is permitted to take employment
OR
• A certificate of application issued by the Home Office or the Border and Immigration Agency to or for a family member of a national of a EEA country or Switzerland stating that the holder is permitted to take employment which is less than 6 months old.
